Role overview

Introduction to the role:

This is an exciting opportunity to join a team who provide a full service to insolvency practitioners, banks and other funders, corporates entities and investors. The work of the team broadly falls into three categories, transactional, advisory and contentious.

Transactional work generally involves acting on behalf of an insolvency practitioner (from time to time also a purchaser) on the sale and purchase of a business and/or assets. We also have a strong reputation for our work on distressed real estate assignments, and some real estate sale work is undertaken.

Contentious work is mainly carried out for insolvency office holders and includes a wide variety of Court work that arises during an insolvency including antecedent transactions, wrongful trading, administration extensions, paragraph 71 applications. We also act for defendants in CDDA applications.

Contentious work is carried out for lenders and corporates and includes validation applications, enforcement of security and possession proceedings.

Advisory work includes board support, restructuring, debt advisory work and refinancing.

In this role, you will be advising businesses or individuals facing difficulties, as well as lenders and insolvency practitioners seeking to find resolutions outside and inside of insolvency procedures.

Key responsibilities:



Assisting on prepack insolvency transactions including deal structuring advice, drafting and negotiation of transaction documents, interaction with all stakeholders and general transaction management. Assisting with distressed property assignments including security reviews, appointment of receivers and administrators, validity of appointment advice and sales on behalf of office holders and lenders under power of sale. Advising lenders on validity of security, enforcement strategies, facilitating appointment of office holders. Assisting on board support assignments providing advice and assistance to corporate entities in the 'twilight zone' of solvency. Having a good working knowledge of and ability to advise comprehensively on insolvency litigation practice and procedures in both corporate and personal insolvency claims context. Being able to identify litigation funding options available to clients and advise on their ability to secure litigation funding and/or insurance options as appropriate. Being able to effectively and pro-actively manage own case load (appropriate to 5+ years of PQE) Briefing Counsel and/or third party experts as required on specific case assignments.

Experience in contentious aspects of distressed real estate work - whether for office holders or lenders.
