Balfour Beatty is looking for a highly competent Head of Commercial who will be responsible for ensuring adherence to the business's commercial expectations and governance procedures both internally and throughout the wider supply-chain.They will also be responsible for the correct administration of the main contract ensuring compliance and consistency across the wider team and also lead the team responsible for change control, working closing with project controls.The role will also incorporate commercial audit, training and upskilling.
The individual will be an experienced professional, who has previously worked on operational project delivery, and contract negotiations, including the development of internal joint ventures and assembly of specialist supply chain partners in complex and high value construction, building services and infrastructure projects.They would need to demonstrate a high-level understanding of NEC forms of contract and have demonstrable experience in contract drafting, negotiation and execution of related commercial aspects. The business is seeking someone who self-motivated, organised and has an ability to operate independently as well as part of a project team; often working to tight deadlines.What you'll be doingAs a Head of Commercial, you will be accountable for the following activities;

  • Looking at the bigger picture and prioritising business opportunities
  • Deputising for the Project Commercial Director when required
  • Reviewing contract / sub-contracts and provide advice in line with company policies
  • Liaise with JV partners on all commercial/ contractual matters.
  • Understanding dispute resolution and how to avoid it through proactive management of the contract
  • Be proactive in ensuring 'lessons learned' from previous projects are flagged, mitigated or de-risked through contract negotiations.
  • Arrange for Contracts / Sub-contracts to be executed in accordance with the Delegated Levels of Authority and Group redlines.
  • Understanding the application of legislation
  • Liaising with in-house legal experts where required to support the project
  • Preparation / review of contract document including the interpretation of specixefxacx81cations & preambles
  • Representation of the xefxacx81nancial and contractual interests to your employer and client
  • Liaising with all parties and stakeholders to ensure task/project remains on plan
  • Management and reporting of commercial risk and opportunity
  • Management of the contract administration and change control process
  • Support the management of disallowed cost
  • To be able to report and explain the commercial aspects to senior staff
  • Ensuring the team adheres to the Company's governance requirements and seeks
to maximise LEAN/digital opportunitiesWho we're looking for
  • The candidate will be an experienced individual who has signixefxacx81cant industry experience and a track record of managing and developing a commercial team and ideally be a Chartered Member of the RICS, ICES or CIOB. They will mentor/role model to other commercial staff on their journey to becoming professionally qualixefxacx81ed.
  • They will have proven skills in commercial awareness, client liaison, project
management and team leadership. They will also have an extensive understanding of the construction/infrastructure industry, demonstrate xefxacx82exibility and possess a talent for negotiation.
  • BSc or MSc in Quantity Surveying and/or LLB/LLM or signixefxacx81cant equivalent experience.
  • Someone who has extensive knowledge and experience of negotiation and agreement of FEED, Professional Services Agreements, Alliance Agreements, Joint Venture Agreements and complex, high value engineering and construction contracts, particularly NEC contracts.
  • Appreciation of procurement routes and contract terms and negotiation skills
