Position Overview:
T o build and manage our asset, development and property management capability.
Supporting Vice President in building an effective and scaleable legal function and processes for the development and expansion of an ever-growing portfolio.
Collaborating with Development Management and Portfolio Management teams to enhance value.
Managing construction and development projects and dispute resolution tactics, ensuring compliance with construction laws and regulations.
Contributing to ESG initiatives including energy efficiency and solar projects.
As the lead attorney on assigned transactions, collaborate with the Development Management team ("DM"), Portfolio Management team ("PM"), contractors and external advisors in managing a variety of real estate assets and real estate owning companies, including but not limited to multi-let assets across the United Kingdom and Europe, and development projects, for the Company's rapidly growing European real estate portfolio.
Lead on assigned matters and manage all necessary legal services, in combination with third-party service providers.
Where necessary, supervise Legal Analysts working on assigned matters.
Collaborate with the Company's interdisciplinary team of professionals to devise an optimal construction, value add, energy efficiency and solar initiatives and construction litigation approach and provide proactive legal advice to the Company's executives.

Management:
Coordinate, analy s e, manage, negotiate, document and close a wide range of multifaceted construction projects.
Provide legal advice on all phases of construction projects including procurement, project delivery, dispute avoidance and resolution .
Advise on risk management strategies and ensure contracts comply with relevant laws, regulations, and company policies.
Where applicable, s upervise assigned Legal Analyst s and collaborate with interdisciplinary team to devise optimal approach in context of assigned transaction.
Handle wide range of routine-to-complex construction legal matters, e.g., draft / review / negotiate construction-related contracts including JCT, NEC, FIDIC , framework agreements, appointments, collateral warranties, letters of reliance, letters of intent, bonds , parent company guarantees , third party supplier agreements, permits, licences, and bespoke agreements , etc.
Review solar panel installation, electric vehicle installation, energy and income sharing agreements .
Attend director meetings and present transactions to the board of directors, coordinate execution of documents, and assist with entity management responsibilities where required.
Analy s e transactions and structuring on transactions in the UK and other countries as necessary.
Review, evaluate and approve information and reports received from external advisors in connection with construction matters.
Manage and monitor construction and environmental issues from a legal perspective. Review and analyse construction , development and environmental reports.
Supervise Legal Analyst s in coordinating their own construction matters where applicable .
Exercise creativity and resourcefulness in resolving legal matters effectively and efficiently.
Consult with DM and PM on deal structuring, compliance with contract terms, construction laws and regulations , and interpretation of contract terms, conditions and issues.
Develop and make recommendations to Legal team regarding improvements to internal policies and procedures for handling construction projects and litigation .
Contractor and subcontractor d efaults:
+ Advise the Company on best practice in the event of contractor and subcontractor defaults;
+ Retain and oversee external solicitors as and when necessary and instructed . Manage/oversee routine-to-complex disputes, litigation and retain/supervise outside legal counsel , including but not limited to claims for delays, defects, variations, termination , mediation, adjudication, arbitration, ADR and litigation to resolve construction disputes efficiently and effectively.
Identify potential legal risks in construction projects and advise on strategies to mitigate them.
Handle miscellaneous construction and development issues.
Provide clarification on legal language or specifications to DM and P M .
Research and evaluate different risk factors regarding business decisions and operations.
Apply effective risk management techniques and offer proactive advice on possible legal issues.
Communicate and negotiate with external parties (brokers, external counsel, third party vendors etc.), creating relationships of trust.
Provide professional legal counsel and advice to Company executives.
General:
General legal research and investigation.
Routine advice/counsel to all departments on legal matters.
General legal document review, drafting and negotiating.
Special projects and duties as assigned.
Contractor Default or Insolvency Scenarios
:
A ssist the Company devising and implementing strategies resulting from contractor and sub-contractor default or other construction-related litigation matters .

Assist as required with legal due diligence on potential acquisitions, developments, and joint ventures.

Knowledge, Skills, and Abilities
Must have for the role:
Qualified Solicitor (England & Wales).
While we do not set upper or lower limits of PQE for any of our vacancies, candidates with at least 6+ years' PQE are likely to have the right level of knowledge and experience in a City law firm or real estate focused investment fund; exceptional candidates outside of this range will be considered; with substantial experience in commercial real estate transaction law and real estate litigation.
S olid understanding of construction law, construction contracts, real estate development, regulations and relevant legislation.
Experience with infrastructure, real estate development, and energy projects.
Expe rience with working on construction disputes , i ncluding complying with the Pre-action Protocol for Construction and Engineering Disputes in the preparation of letters of claim and letters of response, TCC litigation, adjudication and ADR .
Have a positive attitude with the enthusiasm and energy to develop the new legal processes and frame works for our construction and development projects .
Fluent (spoken and written) English.
Ability to handle a varied workload and work autonomously in a fast-paced environment.
Excellent knowledge and understanding of English construction law, and construction litigation.
Highly effective written and verbal communication skills; ability to communicate complex ideas and issues clearly and concisely.
Ability to read, analy s e and interpret a wide variety of complex legal documents and agreements.
Adept and proficient at advanced legal document drafting and negotiating.
Ability to effectively identify, research and analy s e routine-to- complex legal issues, assess potential exposure, propose alternative courses of action and make well-reasoned recommendations.
Ability to exercise creativity and resourcefulness in problem-solving and promote effective and efficient resolution of legal matters.
Ability to analyse complicated and complex legal matters and make well-reasoned judgements to minimise risk and add value to the Company.
Ability to effectively manage time, handle multiple projects concurrently, work under pressure and meet deadlines.
Desirable but not essential:
E xperience of construction in continental Europe .
