JOB PURPOSE
1. To support and provide an efficient, effective and complete Mental Health Act administration service on behalf of the Trust for patients who are formally detained; ensuring that the requirements of the law are met and that the rights of patients subject to the Act are safeguarded.
2. All Training provided good organisational and admin skills required.
3. To provide admin support to the MHA Supervisors under their guidance, as a member of the corporate Mental Health Law administration team, assisting and supporting the implementation of administrative policies and procedures to ensure compliance with the MHA 1983, MHA 2007 and associated legislation, guidance, policies, and procedures.
MAIN DUTIES AND RESPONSIBILTIES
1. To develop and maintain key working relationships including Mental Health Act colleagues, legal representatives, multidisciplinary health and social care professionals and team managers, to ensure a high quality service.
2. To liaise with the Tribunal Service, CQC, Ministry of Justice, the Courts and other agencies as appropriate.
3. To assist colleagues in providing expert knowledge/advice to staff on aspects of mental health law to ensure compliance, with support from the MHA Administration team.
Legal Paperwork:
1. To carry out the day-to-day administration of the Mental Health Act, using agreed procedures, ensuring that all administrative requirements of the Mental Health Act 1983 are followed and adhered to during the admission of detained patients.
2. Assist in accepting and scrutinising all section papers and related legal documentation for detained patients in line with the requirements of the MHA 1983 and MHA 2007.
3. To seek advice, on remedial action to be taken to ensure patients are lawfully detained at all times and where necessary make arrangements for the urgent rectification of detention papers within the legal time limits specified.
4. Assist in the filing/uploading to patient records of information, completed statutory paperwork and associated legal documentation, compliant with the law.
5. Assist in preparation of records of detained patients ensure they are maintained within the statutory time limits and adhere to statutory requirements - including the renewal of sections, section 132 Rights and consent to treatment forms.
Information and monitoring:
1. To maintain up to date electronic diary systems with regard to patients detained under the Mental Health Act 1983, ensuring the relevant consultant psychiatrist/Responsible Clinician (RC) and ward staff are properly informed of due dates for consent to treatment and section expiry in line with statutory timescales and related guidance.
2. To fully maintain the Mental Health Act module on the RiO Electronic Patient Records System entering all Mental Health Act related data including admissions, discharges, transfer, appeals, renewals, consent to treatment, AWOL, leave etc. and to assist by contributing to the further development and functionality of the RiO MHA module.
3. To maintain an accurate and up to date electronic 's117 register' of those patients entitled to receive statutory aftercare under the Mental Health Act 1983.
Patient's Rights:
1. To support the rights of patients detained under the Mental Health Act and ensure that procedures are adhered to that are in place to uphold their rights, ensuring that all detained patients are made aware of their rights under section 132 of the Mental Health Act 1983 in liaison with ward staff.
2. To provide written information to detained patients on their rights on admission and when requested and to meet with patients if requested to provide information and advice about their rights in liaison with ward staff.
3. To provide the 'nearest relative' with information about rights/powers under the Act and assistance to appeal or give notice of discharge if they should wish to do so.
4. To ensure that the rights of all detained patients are upheld on an equal basis and that all hearings are arranged taking account of the needs of diverse community groups.
5. To assist with and facilitate the preparation for visits by Care Quality Commissioners, in liaison with managers and clinicians, as well as assisting commissioners on the day of the visit and supporting the MHA Administration Manager with any follow up work or information required following the visit.
Mental Health Act Hospital Managers Reviews:
1. Provide assistance in organising dates for Mental Health Act Hospital Managers Hearings. Mental Health Review Tribunals: 1. To assist in the organisation of Tribunal hearings, collate reports from psychiatrists, social workers, nurses, informing solicitors advocates and other professionals/agencies as appropriate; requesting medical, social circumstances and nursing reports from the identified professionals, ensuring they are received and forwarding them to the MHRT within the statutory time limits, finding representation for patients, booking venues and ensuring the hearings are serviced appropriately and efficiently in line with established procedures and provide any other documentation requested by the MHRT in preparation for the hearing and distribute the decision forms as required.
2. To seek support in obtaining legal advice where necessary or appropriate in relation to issues arising around detentions, adhering to established Trust procedures. Other Duties and Responsibilities: 1. To monitor the booking system for rooms available for use within the Mental Health Unit. 2. To ensure that the photocopier and other equipment is in working order and available for use, in good working order at all times.
3. To maintain a professional appearance and provide assistance at all times - giving a courteous and helpful service to all those who come into contact with the Mental Health Act Office.
4. Aim to keep up to date with mental health law and any changes that may affect the administering of the Act.
5. To attend and participate in Mental Health Act Administration Team meetings and any other meetings as required.
