The Mental Health Tribunal for Scotland (MHTS) have a truly unique and exciting opportunity to join the team as a Tribunals Hearings Clerk within Hamilton and the surrounding areas on a full time permanent basis.

The Mental Health Tribunal for Scotland (MHTS) was created on 5 October 2005 by virtue of section 21 of the Mental Health (Care and Treatment) (Scotland) Act 2003 ("the 2003 Act"). The Tribunal's headquarters are located in Hamilton and it also has staff who work throughout Scotland. The Tribunal discharges its functions through panels of three members: a legal member (who acts as Convener), a medical member and a general member. The judicial arm of the Tribunal is supported in its functions by the staff of the Scottish Courts and Tribunals Service (SCTS).The primary role of the Tribunal is to consider and determine applications for compulsory treatment orders (CTOs) under the 2003 Act and to operate in an appellate role to consider appeals against compulsory measures made under the 2003 Act. The Tribunal also plays a monitoring role by periodic review of compulsory measures.

The

Key Responsibilities Include:




Attend Tribunal venues (Hospital and Community based) to facilitate MHTS hearings acting as a facilitator for on the day administrative functions in line with set processes, maintaining regular contact with HQ.

Plus:


Complete Risk Assessments at Tribunal venues dealing with any minor and immediate issues at the hearing and reporting any concerns to your Team Leader immediately. Complete necessary hearings documentation within set timescales. Travel throughout Scotland to facilitate hearings, which may occasionally involve working extended hours. Making use of mobile IT equipment. This will be your responsibility to ensure this is secure at all times. Collate all relevant case information, liaising with external stakeholders and the President's Office as necessary. Embrace multi functioning initiative across SCTS. Work closely with our Continuous Improvement Team to maximise efficiencies within SCTS. Complete mandatory E-Learning as required. General administration tasks as required.


We offer 3 different modes of tribunal hearings - teleconference, in-person and WebEx. Clerks are expected to facilitate hearings via one of these methods. This will require travelling throughout Scotland to various venues.
