Job Description

As a Clinical Negligence Paralegal it will be your responsibility to assist the Fee Earners in the Team to provide legal advice on all areas of clinical negligence. You will be expected to assist in all aspects of their caseload, including taking appropriate decisions involving the exercise of judgment, subject to supervision. The level of supervision required will be in accordance with the firm's standard system together with further assistance in relation to key decisions on cases. You will require a sound theoretical knowledge of the work and an awareness of the clinical negligence processes, procedures, and protocols.

The job does not carry any direct supervisory responsibility, but you will play an important role in the team in helping to achieve the Department's objectives. The ability to communicate clearly and effectively is essential.

Typical Duties



While duties may vary depending on the specific nature of each case, the typical responsibilities of a Clinical Negligence Paralegal are to:

1. Take new instructions in a complete and comprehensive manner;

2. Set up/input the new claim on the case management system;

3. Draft and send out to the Client initial paperwork;

4. Telephone the Client and complete the funding telephone call;

5. Ensure receipt of the initial paperwork in a complete and prompt manner;

6. Check the initial paperwork and arrange for any amendments or missing documentation is received;

7. Make BTE legal expense insurance enquiries via sending standard letters and chasing responses;

8. Request all medical records, employment records, personnel records, DWP and HMRC records and accountancy records;

9. Monitor and chase for receipt of records detailed;

10. Where records are not received in accordance with timescale:

Prepare a Pre-action Disclosure Application with supporting statement and documentation for authorisation by supervising solicitor.

11. Review all records and prepare a chronology;

12. Telephone Client obtain a draft preliminary witness statement and schedule of loss;

13. Send preliminary witness statement to Client and make any and all amendments ensuring to receive a signed copy;

14. Prepare a Letter to Counsel enclosing chronology, preliminary witness statement and schedule of loss to review in the file clinic;

15. Liaise with fee earners in order to ascertain the number of cases to be referred to Counsel in file clinic and arrange file clinics;

16. Attend file clinics with Counsel and fee earners in order to review file and confirm if proceed to Milestone 3;

17. Prepare Bundles for Conferences with Counsel, fee earners and Clients;

18. Request updated records every 12 months and ensure these are sent for updated chronology;
